Terms of Service
Last updated: October 2026
1. Purpose
These General Terms of Service govern the relationship between René Escobar (hereinafter, "the Professional") and the natural or legal persons who contract his services (hereinafter, "the Client"), within the framework of the activities of digital architecture, web development, technology consulting and visibility strategy offered through the Website.
2. Contracting Process
The contracting process is carried out according to the following stages:
- Initial enquiry: the Client sends their enquiry through the Website form, by email or via WhatsApp.
- Proposal: the Professional sends a detailed proposal including the scope, price, deadlines and specific conditions.
- Acceptance: the Client accepts the proposal in writing (by email or messaging).
- Deposit: the Client pays the agreed deposit (usually 50% of the total amount).
- Execution: the Professional develops the project in accordance with what has been agreed.
- Delivery and final payment: upon delivery of the project, the remaining amount is paid.
3. Quotations
Quotations are free of charge, individually prepared and valid for 30 calendar days from the date of issue, unless expressly stated otherwise. After this period, the Professional may revise the conditions.
4. Prices and Payment Terms
The prices indicated on the Website are indicative and are expressed in euros, excluding taxes unless expressly stated otherwise. Each project is quoted individually.
The usual payment method is:
- 50% deposit upon acceptance of the proposal, before starting work.
- 50% balance upon delivery of the completed project.
For long-term projects, intermediate billing milestones may be agreed. Non-payment of any instalment entitles the Professional to suspend work until regularisation.
5. Delivery Deadlines
Delivery deadlines are established in each proposal and are conditional upon:
- Timely delivery by the Client of all necessary materials, content and access credentials.
- Prompt approval of the intermediate stages of the project.
- The absence of force majeure events.
Delays attributable to the Client may result in a proportional extension of the agreed deadline.
6. Client Obligations
The Client undertakes to:
- Provide truthful and up-to-date information about their business or project.
- Provide the necessary materials (texts, images, logos, access credentials) with legitimate usage rights.
- Respond promptly to the Professional's approval requests.
- Pay the amounts within the agreed deadlines.
7. Intellectual Property
The Professional retains ownership of his methodologies, frameworks, proprietary libraries and prior know-how. Regarding the delivered project, the Client obtains a licence of use in accordance with what is agreed in the proposal.
The Client is responsible for holding the necessary rights over the content they provide (texts, images, trademarks). The Professional is held harmless from any third-party claims arising from such content.
8. Confidentiality
Both parties undertake to maintain confidentiality regarding sensitive information exchanged during the professional relationship. This obligation remains in force even after the commercial relationship has ended.
9. Referral Programme
The Referral Programme allows users to recommend the Professional's services to third parties. The conditions are:
- The referred person must mention the referral code provided when recommending the service.
- The commission is paid only when the referred person formalises and pays for a complete project.
- The commission amounts to €50 or, at the referrer's choice, one year of free hosting.
- The referrer is responsible for complying with their tax obligations regarding the commission received.
10. Service Exchange
The Professional may accept, at their sole discretion and subject to specific prior agreement, the exchange of services for other goods or services offered by the Client. Such exchange shall be formalised in writing through the corresponding accepted proposal.
11. Limitation of Liability
The Professional shall not be liable for indirect damages, loss of profit, loss of business opportunities or damages arising from improper use of the project by the Client, their employees or third parties. The Professional's maximum liability shall be limited to the amount actually paid by the Client for the project in question.
12. Modifications
The Professional reserves the right to modify these Terms of Service. The conditions in force at the time of acceptance of each proposal shall govern that relationship.
13. Applicable Law and Jurisdiction
These Terms are governed by Spanish law. For any dispute arising from their interpretation or performance, the parties submit to the Courts and Tribunals of Cáceres (Spain), with express waiver of any other jurisdiction.
